These Terms of Service ("Terms") govern your use of the Smart Sober application and website (collectively, the "Service"). By using Smart Sober, you agree to these Terms. Please read them carefully.

Important Medical Disclaimer

Smart Sober is NOT a substitute for professional medical care.

Our app provides peer support and self-help tools, but it is not intended to diagnose, treat, cure, or prevent any disease or medical condition. If you are experiencing a medical emergency, please call 911 or your local emergency services immediately. For mental health crises, contact the 988 Suicide & Crisis Lifeline by calling or texting 988.

Eligibility

You must be at least 18 years old to use Smart Sober. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You agree to provide accurate information and to update it as necessary.

You may not share your account or use another person's account without permission.

Acceptable Use

When using Smart Sober, you agree NOT to:

  • Harass, bully, or intimidate other users
  • Share content that promotes substance abuse or self-harm
  • Impersonate others or misrepresent your identity
  • Share personal information of others without consent
  • Use the Service for any illegal purpose
  • Attempt to access other users' accounts or data
  • Interfere with the proper functioning of the Service

Community Guidelines

Our peer support community is built on mutual respect and understanding. We expect all users to treat each other with compassion and to maintain a safe, supportive environment. Violations of our community guidelines may result in account suspension or termination.

Subscription and Payments

Smart Sober offers a premium subscription service. By subscribing, you agree to:

  • Pay the applicable subscription fees
  • Automatic renewal unless you cancel before the renewal date
  • Our refund policy as outlined in the app stores

Prices may change with notice, but changes will not affect your current subscription period.

Intellectual Property

Smart Sober and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

Limitation of Liability

To the maximum extent permitted by law, Smart Sober shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of Smart Sober after changes take effect constitutes acceptance of the new Terms.
